HIPAA Policy

The "HIPAA" (Health Insurance Portability and Accountability Act of 1996) Standards for Privacy of Individually Identifiable Health Information establish a set of national standards for the protection of protected health information ("PHI"). The HITECH Act of 2009 bolstered these standards. We have implemented a HIPPA/HITECH compliant privacy program that includes appropriate administrative, technical, and physical safeguards, within our Regulatory Compliance Plan, to monitor and maintain protected health information confidentiality according to the regulatory standards, throughout the Company. 

It is Patient Sleep Supplies, Inc. policy not to use or disclose PHI, except as permitted by the HIPAA Privacy Regulations and applicable state laws and regulations. We will reasonably safeguard PHI to limit incidental uses or disclosures made pursuant to an otherwise permitted or required use or disclosure and from any intentional or unintentional use or disclosure that is in violation of the HIPAA and HITECH Acts. 

It is our policy to mitigate, to the extent practicable, any harmful effect that is known to us, due to use or disclosure of PHI by us or one of our business associates in violation of our policies and procedures and the relevant statutes. We will apply appropriate sanctions against employees and business associates who fail to comply with our policies and procedures and the relevant statutes for the protection of PHI and the privacy of individuals.

Our patients frequently require us to make contact with third parties related to their therapy. This contact may be with your physician or with a family member. Patient’s Rights to PHI
 
It is our policy to do all things necessary to ensure our patients are permitted to inspect or obtain a copy of their PHI maintained by us. It is our policy to permit a patient request that their PHI be amended in certain circumstances. Any such amendment requests must be only in relation to PHI maintained by us and must be made in writing providing a reason to support the amendment. Please click link below to download.

Accounting for Disclosures
 
It is our policy to maintain records so as to be able to provide patients an accounting of certain disclosures of their PHI for a six (6) year period, prior to the date on which the accounting is requested.
